1Agreement to Terms
By accessing or using Build73 ("Service", "Platform", "we", "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.
Build73 is a professional web-based SaaS platform for creating, optimizing, and exporting playable ads (interactive HTML5 advertisements) for major advertising networks including Unity Ads, Google AdMob, Facebook Audience Network, TikTok for Business, and others. Our platform uses AI-powered tools to enhance your creative workflow.
2Use License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your commercial or personal purposes, subject to these Terms and your purchased plan limits.

- •Attempt to extract source code or bypass security measures
- •Remove copyright, trademark, or proprietary notices
- •Transfer, resell, or share your account credentials

3Account Registration
To use Build73, you must register for an account. You are responsible for maintaining the security of your account and password. By creating an account, you agree to:

4Credits System & Virtual Currency
Build73 operates on a credit-based system. Credits are virtual currency used exclusively within our platform to access premium features and services:

- •Credits are virtual goods with no monetary value outside Build73
- •Credits are not redeemable for cash; eligible purchase refunds follow the Refund Policy
- •Credits never expire unless your account is terminated for violations
- •We reserve the right to adjust credit pricing with 30 days notice
Each feature and action (AI image generation, code optimization, export to ad networks, etc.) has a specific credit cost displayed before use. Credits can be purchased as one-time packs or obtained through subscription plans.
5Pricing & Plans
Build73 offers two types of purchases: monthly subscription plans for platform access and one-time credit packs for additional AI features.

6Purchases, Card Payments & Cancellation
Choose a plan or credit pack and review the displayed price before confirming your order. For card purchases, you are redirected to TBC Bank’s secure hosted payment page to enter card details. Build73 does not collect or store raw card numbers, expiry dates, or CVV codes.
- •Provide accurate account and billing information and review the order total before payment
- •Authorize TBC Bank to process the card payment on its hosted page
- •Receive paid access or credits in your Build73 account after successful payment confirmation
- •Contact support@build73.com with your account email and transaction reference if delivery or billing fails
Subscription cancellation
To cancel a subscription, use the account cancellation controls where available or email support@build73.com before the next billing date. Cancellation stops future renewals; access continues through the paid period. One-time credit-pack purchases do not renew automatically. Refund requests follow the Refund Policy.
7Intellectual Property Rights
🏢 Our Content:
The Service, including all software, code, algorithms, features, user interface, design, trademarks, and documentation, is owned by Build73 and protected by international copyright, trademark, patent, and trade secret laws.
👤 Your Content:
You retain all ownership rights to content you create, upload, or generate using Build73. By using the Service, you grant us a limited, worldwide, non-exclusive license to host, store, cache, and process your content solely to provide and improve the Service. This license terminates when you delete your content or account.
8User-Generated Content & Responsibilities
You are solely responsible for all content you upload, create, or share through Build73. You represent, warrant, and covenant that:
- ✓You own or have obtained all necessary rights, licenses, and permissions
- ✓Your content does not infringe any intellectual property or proprietary rights
- ✓Your content complies with all applicable laws and regulations
- ✓Your content is free from malware, viruses, or harmful code
- ✓Your content does not violate privacy rights or contain illegal material
9Prohibited Uses & Conduct
You agree not to use Build73 or engage in any of the following prohibited activities:
- ✗Violating any local, state, national, or international laws
- ✗Transmitting malware, viruses, or any malicious or harmful code
- ✗Impersonating any person or entity, or falsely representing affiliations
- ✗Harassing, abusing, threatening, or harming any individual
- ✗Scraping, data mining, or automated data collection without permission
- ✗Interfering with, disrupting, or attacking our servers or infrastructure
- ✗Creating illegal, fraudulent, defamatory, or explicitly adult content
- ✗Attempting to circumvent usage limits, security measures, or credit costs
10Account Termination & Suspension
We reserve the right to suspend or terminate your account and access to Build73 immediately, with or without notice, for any reason including:
- •Violation of these Terms of Service
- •Fraudulent, abusive, or illegal activity
- •Chargebacks or payment disputes
- •Extended inactivity (12+ months)
Upon termination, your right to use the Service ceases immediately. Unused credits may be forfeited unless otherwise stated in our Refund Policy. You may export your projects within 30 days of account termination.
11Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Build73, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, use, goodwill, or other intangible losses, resulting from:
- • Your use or inability to use the Service
- • Unauthorized access to or alteration of your content
- • Service errors, interruptions, or delays
- • Third-party content or conduct
Our total aggregate liability shall not exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim.
12Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no guarantees that the Service will be uninterrupted, secure, error-free, or meet your requirements.
13Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of material changes via email or prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
14Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Georgia (საქართველო), without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of Tbilisi, Georgia, and you consent to personal jurisdiction therein.
